Il testo di Foucault rappresenta uno dei più importanti lavori dell’era contemporanea nella ricostruzione del rapporto reato-sanzione. Da Beccaria in poi la funzione dello Stato in relazione alla repressione dei reati, attraverso la punizione dei colpevoli, ha assunto ruolo importante nell’ambito del dibattito sociale. Foucault ha svolto un importante lavoro di analisi e di approfondimento su un tema estremamente complesso. Molto interessante è l’analisi delle regole moderne che presiedono il criterio della prevenzione dei reati. Con lo storico passaggio del dente per dente ad un sistema penale basato sulla detenzione. Ma la prigione, e questo uno dei punti nodali di questo saggio, gradua la pena sostanzialmente con un solo elemento: il tempo. Questo non consente alla pena di assolvere alla funzione redentiva, non essendoci una diretta correlazione tra pena e reato. Un libro estremamente interessante frutto di un’analisi attenta e metodologicamente corretta. ( )
